Copyright Policy

This Copyright Policy ("Policy") sets out how Templeton Built Pty Ltd, operating ChangeOrdersPro ("we," "us," or "our"), addresses intellectual property rights on www.changeorderspro.com and the ChangeOrdersPro Service. This Policy is incorporated into and forms part of our Terms of Service.

1. Our Intellectual Property

1.1 Ownership

All content, features, and functionality on the Service — including but not limited to the software, source code, algorithms, interfaces, visual designs, graphics, icons, text, documentation, trademarks, service marks, logos, and the selection and arrangement of all such elements — are the exclusive property of Templeton Built Pty Ltd or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

1.2 Restricted Rights

Nothing in these Terms or this Policy grants you any right, title, or interest in the Service or our intellectual property other than the limited license described in the Terms of Service. You may not reproduce, distribute, publicly display, publicly perform, prepare derivative works from, or otherwise exploit any element of the Service without our prior express written consent, except as permitted under applicable law.

1.3 Our Trademarks

"ChangeOrdersPro" and associated logos and marks are proprietary marks of Templeton Built Pty Ltd. You may not use our marks in any manner that suggests sponsorship, endorsement, affiliation, or partnership with us without our prior written approval.

2. Your Content

You retain ownership of Customer Content you submit to the Service. By submitting Customer Content, you represent and warrant that:

  • you own, or have obtained all necessary rights and licenses to, the Customer Content;
  • the Customer Content does not infringe, misappropriate, or violate any third-party intellectual property right, privacy right, right of publicity, or any applicable law; and
  • you have obtained all required consents for photographs of identifiable individuals contained in Customer Content.

You are solely responsible for any claim arising from Customer Content you upload or transmit through the Service.

3. DMCA — Notice of Copyright Infringement

3.1 Reporting Infringement

If you believe that content on the Service infringes your copyright, please submit a written notification (a "DMCA Notice") to our designated Copyright Agent at legal@changeorderspro.com. Your DMCA Notice must include all of the following, as required by 17 U.S.C. § 512(c)(3):

  • a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • identification of the copyrighted work claimed to have been infringed;
  • identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate the material (such as a URL);
  • your contact information, including your full legal name, mailing address, telephone number, and email address;
  • a statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law; and
  • a statement, made under penalty of perjury, that the information in your notification is accurate, and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

3.2 Our Response

Upon receipt of a valid DMCA Notice, we will promptly act to remove or disable access to the allegedly infringing material. We will notify the account holder who posted the material of the removal and provide a copy of the DMCA Notice.

3.3 Counter-Notice

If you believe that material was removed or disabled as a result of mistake or misidentification, you may submit a Counter-Notice to legal@changeorderspro.com. A valid Counter-Notice must include:

  • your physical or electronic signature;
  • identification of the material that has been removed and its previous location;
  • a statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  • your name, address, and telephone number; and
  • a statement that you consent to the jurisdiction of the Federal District Court for your district (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the complainant.

Upon receipt of a valid Counter-Notice, we may restore the removed material in accordance with the DMCA, unless the complaining party files a court action within the statutory time period.

4. Repeat Infringer Policy

In accordance with the DMCA and applicable law, we maintain a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed repeat infringers of third-party intellectual property rights.

5. Third-Party Content and Links

The Service may contain links to third-party websites, content, or services. We are not responsible for and do not endorse any third-party intellectual property, and we have no control over third-party content. If you believe that any linked third-party content infringes your intellectual property rights, please contact the relevant third party directly.

6. Open Source Software

The Service may incorporate open-source software components. The applicable open-source licenses govern those components. Nothing in these Terms or this Policy restricts rights granted to you under the applicable open-source license terms.

7. Fair Use and Permitted Uses

Nothing in this Policy is intended to limit any rights you may have under the fair use doctrine (17 U.S.C. § 107), the fair dealing doctrine, or other applicable exceptions to copyright law.

8. Changes to This Policy

We may update this Copyright Policy at any time. Material changes will be notified by email and posted on the Service with an updated effective date. Continued use of the Service after the effective date constitutes acceptance.
